Welcome to Imaginify! These Terms of Service ("Terms") govern your access to and use of Imaginify's AI-powered video creation platform. By creating an account or using our services, you agree to be bound by these Terms. Please read them carefully.
1. Acceptance of Terms
By accessing or using Imaginify, you agree to:
Be bound by these Terms of Service and all applicable laws and regulations
Comply with our Privacy Policy and Refund Policy
Be at least 18 years of age or have parental consent
Provide accurate and complete information when creating your account
Important: If you do not agree with these Terms, you may not use Imaginify. We reserve the right to modify these Terms at any time, and continued use after changes constitutes acceptance.
2. Service Description
What Imaginify Provides
Imaginify is an AI-powered platform that generates user-generated content (UGC) style videos from product images. Our service includes:
AI-powered video generation from static product images
Multiple video durations (5, 10, 15 seconds)
Portrait and landscape video formats
Various UGC styles and customization options
Credit-based system for video generation
Video history and management dashboard
Service Availability
While we strive for 99.9% uptime, Imaginify is provided "as is" and "as available." We do not guarantee uninterrupted access and may perform maintenance, updates, or experience technical issues that temporarily affect service availability.
3. Account Registration & Security
Account Requirements
You must provide accurate, current, and complete information during registration
You are responsible for maintaining the confidentiality of your account credentials
You must notify us immediately of any unauthorized access to your account
You may not share your account with others or create multiple accounts
You may not use another person's account without permission
Account Termination: We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or misuse our services.
4. Subscriptions & Billing
Subscription Plans
Imaginify offers monthly subscription plans with recurring billing. By subscribing, you authorize us to charge your payment method:
On your subscription start date
Automatically on each renewal date (monthly)
For any additional credit purchases or upgrades
Cancellation Policy
You may cancel your subscription at any time through your account settings:
Cancel Anytime: No questions asked, instant cancellation
Access Until End: Keep using Imaginify until your current billing period ends
No Refunds: Cancellation does not entitle you to a refund for the current billing period
Credits Expire: Unused credits expire when your subscription ends
Payment Terms
All fees are in USD and charged in advance. You are responsible for providing a valid payment method and keeping your billing information current. Failed payments may result in service suspension.
5. Acceptable Use Policy
Permitted Use
You may use Imaginify to:
Create videos for personal or commercial use
Use generated videos in marketing campaigns, social media, and advertisements
Upload product images you own or have permission to use
Download and store your generated videos
Prohibited Use
You may NOT use Imaginify to:
Upload images containing illegal, harmful, or offensive content
Violate intellectual property rights (copyrights, trademarks, etc.)
Upload images of people without their consent
Create deepfakes, misleading content, or impersonations
Attempt to reverse engineer, hack, or exploit our AI models
Resell, redistribute, or sublicense Imaginify services
Use automated scripts or bots to abuse the service
Generate content that violates laws or regulations
Violation of these policies may result in immediate account suspension or termination without refund.
6. Intellectual Property Rights
Your Content
You retain all ownership rights to the product images you upload. By uploading content, you grant Imaginify a limited license to:
Process your images through our AI models to generate videos
Store your images temporarily (30 days) for revision purposes
Display your content within your account dashboard
Your Guarantee: We never use your images or videos for marketing, training AI models, or any purpose beyond generating your requested videos without your explicit consent.
Generated Videos
You own the videos generated by Imaginify and have full commercial usage rights. You may use them for any legal purpose, including:
Marketing campaigns and advertisements
Social media content
E-commerce product listings
Client deliverables (for agencies)
Imaginify Platform
All rights, title, and interest in Imaginify's platform, AI models, algorithms, branding, and technology remain the exclusive property of Imaginify. You may not copy, modify, or create derivative works from our platform.
7. Disclaimers & Limitations of Liability
Service Disclaimer
Imaginify is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. We do not guarantee that:
The service will be uninterrupted, error-free, or completely secure
AI-generated videos will meet your specific expectations or requirements
All generated content will be perfect or require no editing
Video generation times will always match estimates
Limitation of Liability
To the maximum extent permitted by law:
Imaginify shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of our service. Our total liability shall not exceed the amount you paid for the service in the past 12 months.
Indemnification
You agree to indemnify and hold Imaginify harmless from any claims, damages, or expenses arising from your use of the service, violation of these Terms, or infringement of any rights of others.
8. Data Privacy & Security
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy.

Automatic data deletion after specified retention periods

9. Modifications to Terms

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles.
Dispute Resolution
Any disputes arising from these Terms or your use of Imaginify shall be resolved through binding arbitration, except for claims that may be brought in small claims court. You waive your right to participate in class action lawsuits.
